What information should be provided?
Section two of article 22 of the LSSI establishes that users must be provided with clear and complete information on the use of data storage and retrieval devices and, in particular, on the purposes of data processing. This information must be provided, as indicated, with
in accordance with the provisions of the GDPR, which requires that the processing of user data be carried out in a transparent manner for them.
Therefore, the information about cookies provided at the time of requesting consent must be sufficiently complete to allow users to understand their purposes and the use to which they will be put.

Definition and generic function of cookies
This website uses cookies and/or similar technologies that store and retrieve information when you browse. In general, these technologies can serve very diverse purposes, such as, for example, recognizing you as a user, obtaining information about your browsing habits, or customizing the way in which content is displayed. The specific uses we make of these technologies are described below.
Information about the type of cookies used and their purpose
Types of cookies according to the entity that manages them
Own cookies: These are those for which the publisher itself is responsible and which are generally sent to the user's terminal equipment from a computer or domain managed by the publisher itself and from which the service requested by the user is provided.
Third party cookies: are those for which an entity other than the publisher is responsible and which are generally sent to the user's terminal equipment from a computer or domain that is not managed by the publisher, but by another entity that processes the data obtained through the cookies.
Types of cookies according to their purpose
Technical cookies: are those that allow the user to navigate through a website, platform or application and use the different options or services that exist therein, including those that the editor uses to allow the management and operation of the website and enable its functions and services, such as, for example, controlling traffic and data communication, identifying the session, accessing restricted access parts, remembering the elements that make up an order, carrying out the purchase process of an order, managing payment, controlling fraud linked to the security of the service, making the request for registration or participation in an event, counting visits for the purposes of billing licenses for the software with which the service works (website, platform or application), using security elements during navigation, storing content for the dissemination of videos or sound, enabling dynamic content (for example, animation for loading text or images) or sharing content through social networks.
Also belonging to this category, due to their technical nature, are those cookies that allow the management, in the most efficient way possible, of the advertising spaces that, as another element of design or "layout" of the service offered to the user, the editor has included in a web page, application or platform based on criteria such as the edited content, without collecting information from users for different purposes, such as personalizing that advertising content or other content.
Technical cookies will be exempt from compliance with the obligations established in article 22.2 of the LSSI when they allow the provision of the service requested by the user, as is the case with the cookies listed in the previous paragraphs. However, if these cookies are also used for non-exempt purposes (for example, for behavioural advertising purposes), they will be subject to these obligations.
Preference or personalization cookies: On this website calls functional, are those that allow information to be remembered so that the user accesses the service with certain characteristics that can differentiate their experience from that of other users, such as, for example, the language, the number of results to display when the user performs a search, the appearance or content of the service depending on the type of browser through which the user accesses the service or the region from which the user accesses the service, etc.
If the user chooses these features (for example, if the user selects the language of a website by clicking on the icon of the flag of the corresponding country, the currency to be used in transactions, the font size or the colour contrast between the background and the content to improve readability), the cookies will be exempt from the obligations of article 22.2 of the LSSI because they are considered a service expressly requested by the user, and this is provided that the cookies obey exclusively the selected purpose. These preference cookies that affect the user interface will not necessarily have to be session cookies, since requesting that the user determine their preferences for these purposes each time they visit a website or access an application can be annoying and cause fatigue. However, for these cookies to be considered exempt, their use must be limited to what is necessary for their purpose, and the information that may be derived from the user's selection cannot be used for other purposes (for example, for the personalization of advertising content) or to create a user profile.
Analysis or measurement cookies: These are those that allow the person responsible for them to monitor and analyze the behavior of users of the websites to which they are linked, including the quantification of the impacts of the advertisements. The information collected through this type of cookies is used
in measuring the activity of websites, applications or platforms, in order to introduce improvements based on the analysis of usage data made by users of the service.
Regarding the processing of data collected through analysis cookies, the GT29 stated that, although they are not exempt from the obligation to obtain informed consent for their use, it is unlikely that they represent a risk to the privacy of users provided that they are first-party cookies, that they process aggregated data for strictly statistical purposes, that information is provided on their uses and that the possibility for users to express their refusal to use them is included.
In any case, it should be noted that these types are provided as a guideline as they are the most common. Editors and third parties may make the categorizations that they consider best suited to the purposes of the cookies they use, in such a way that the principle of transparency towards users is respected.
Types of cookies according to the length of time they remain activated
Depending on the length of time they remain activated on the terminal equipment, we can distinguish:
Session cookies: These are designed to collect and store data while the user is accessing a web page. They are usually used to store information that is only of interest to keep for the provision of the service requested by the user on a single occasion (for example, a list of purchased products) and they disappear at the end of the session.
Persistent cookies: are those in which the data remains stored in the terminal and can be accessed and processed for a period defined by the person responsible for the cookie, which can range from a few minutes to several years.
Identifying who uses cookies
We identify whether the information obtained by cookies is processed only by the publisher and/or also by third parties with whom the publisher has contracted the provision of a service for which the use of cookies is required, with identification of the latter.
In line with the requirement of conciseness established by the GDPR, it will not be necessary for specific information about third parties (i.e. their name or brand by which the public can know them and, where appropriate, the link to the information they offer about their cookies) to be directly visible in the cookie policy, but mechanisms such as buttons that display this more specific information or pop-up text that appears when the mouse pointer passes over it may be used, provided that the user can easily access the information if they so wish.
Information on how to accept, deny or revoke consent for the use of cookies
Once stated through the functionalities provided by the editor (the cookie management or configuration system that has been enabled) or through the common platforms that may exist for this purpose.

They are regulated according to the different purposes in the terms established in article 13.2 a) of the GDPR.
How should that information be displayed?
Information or communication must be concise, transparent and intelligible.
Information should be concise to avoid information fatigue and should use clear and simple language so that it can be understood by an average user.
Clear and simple language must be used, avoiding the use of phrases that lead to confusion or distort the clarity of the message.
For example, phrases such as “we use cookies to personalize your content and create a better experience for you” or “to improve your browsing experience” or phrases such as “we may use your personal data to offer personalized services” would not be valid when referring to behavioral advertising cookies.
Terms such as “may,” “might,” “some,” “often,” and “possible” should also be avoided.
